Strategic Participation Notice

1. About This Notice

This Strategic Participation Notice applies to participation in STEXEN workshops, training, mentoring, programs, challenges, communities and related learning or development activities, together with resources provided for those purposes.

These activities are operated by Excellent Sense Pty Ltd (ABN 36 168 974 945) under relevant registered business names, including STEXEN Solutions.

For convenience, references to “STEXEN” describe the relevant STEXEN-related brands, services and activities operated by Excellent Sense Pty Ltd.

“STEXEN” does not refer to a separate legal entity.

References to “we”, “us” and “our” mean Excellent Sense Pty Ltd.

2. Purpose of Participation

STEXEN programs and resources are practical and strategic by design.

They are intended to support:

• professional growth;
• stronger leadership;
• clearer thinking;
• improved communication;
• capability development;
• healthier workplace relationships;
• better accountability and ownership;
• constructive collaboration; and
• improved individual, team or organisational performance.

Leadership, professional development and organisational development are inherently contextual.

No framework, exercise, script, recommendation, discussion, reflection tool or other resource should be applied without appropriate professional judgement.

Participants remain responsible for determining what is appropriate for their:

• role;
• organisation;
• team;
• circumstances;
• responsibilities; and
• applicable professional, legal or workplace obligations.

3. Professional Judgement and Appropriate Use

Many STEXEN activities encourage:

• reflection;
• honest dialogue;
• constructive challenge;
• feedback;
• accountability;
• self-awareness; and
• behaviour change.

Participants are expected to use these tools professionally, respectfully and with appropriate judgement.

Where relevant, participants should use STEXEN resources in a way that supports:

• psychological safety;
• respectful workplace conduct;
• professional communication;
• fair decision-making; and
• appropriate organisational processes.

STEXEN resources should not be used as:

• pressure or manipulation tactics;
• substitutes for appropriate management or governance processes;
• disciplinary mechanisms;
• replacements for formal workplace investigations;
• substitutes for professional intervention where required; or
• substitutes for decisive leadership where direct action is reasonably necessary.

4. Professional and Other Advice

STEXEN resources are provided for professional development, education, mentoring, strategic support and capability-building purposes.

Unless expressly agreed otherwise as part of a professional engagement, they do not replace:

• legal advice;
• human resources advice or procedures;
• medical or psychological care;
• financial or tax advice;
• workplace investigations;
• regulatory requirements;
• organisational policies;
• professional standards; or
• other specialist professional advice.

Participants and organisations remain responsible for ensuring their decisions, actions and communications comply with applicable:

• laws;
• policies;
• contracts;
• professional obligations;
• workplace requirements; and
• regulatory standards.

Where specialist advice is required, participants should obtain that advice from an appropriately qualified professional.

5. Participant Conduct

When participating in a STEXEN workshop, challenge, mentoring session, training program, online community or other group activity, participants are expected to:

• communicate respectfully and professionally;
• contribute constructively;
• respect different perspectives and experiences;
• avoid harassment, discrimination, intimidation or abusive behaviour;
• protect confidential or sensitive information shared by others;
• avoid sharing information about another person or organisation without appropriate authority;
• comply with applicable program or community rules; and
• behave in a manner consistent with a safe and professional learning environment.

STEXEN may take reasonable action where participant conduct materially conflicts with these expectations, applicable program rules, community guidelines or STEXEN Terms & Conditions.

Such action may include:

• requesting that conduct be corrected;
• limiting access to an activity;
• restricting participation;
• removing content; or
• removing a participant from a program or community where reasonably necessary.

Any contractual consequences will be governed by the applicable Terms & Conditions or specific program terms.

6. Confidentiality and Information Sharing

Participants should exercise discretion when sharing workplace, personal, client, employee or organisational information.

STEXEN encourages participants to avoid:

• identifying individuals unnecessarily;
• disclosing confidential information without authority;
• sharing commercially sensitive information;
• discussing personal information that is not required for the activity; or
• providing information that they are not authorised to disclose.

Where a workshop, mentoring group, challenge or community involves multiple participants, STEXEN may ask participants to respect the confidentiality of information shared within that setting.

However, STEXEN cannot guarantee that another participant will maintain confidentiality.

Participants should therefore not assume that a group or community environment is confidential merely because participants are encouraged to treat information respectfully.

Participants should only share information they are comfortable discussing in the relevant environment and are authorised to disclose.

7. Intellectual Property and Materials

Unless otherwise stated, STEXEN frameworks, training materials, workshop materials, challenges, templates, exercises, videos, presentations, diagrams, methodologies and other resources are owned by or licensed to Excellent Sense Pty Ltd.

Participants may use materials provided to them for their own personal or internal professional development purposes, subject to:

• the STEXEN Terms & Conditions;
• any applicable licence terms;
• program-specific conditions; and
• any written permissions provided by STEXEN.

Unless STEXEN gives prior written permission, participants must not:

• reproduce or republish substantial portions of STEXEN materials;
• sell, sublicense or commercially distribute them;
• upload paid or restricted materials to public repositories;
• use STEXEN materials to create competing commercial training, consulting, mentoring or educational products;
• remove copyright, trademark or proprietary notices; or
• represent STEXEN materials, frameworks or methodologies as their own.

Reasonable internal sharing within an organisation may be permitted where expressly stated in the relevant program, licence or agreement.

8. Outcomes

STEXEN resources and participation activities are designed to support meaningful insight, professional development and practical progress.

However, outcomes depend on many factors, including:

• individual circumstances;
• organisational circumstances;
• readiness;
• consistency;
• engagement;
• communication;
• leadership support;
• available resources;
• quality of implementation; and
• factors outside STEXEN’s control.

Participation in a STEXEN program, workshop, challenge, mentoring activity, community or resource does not guarantee particular:

• business results;
• career outcomes;
• financial results;
• employment outcomes;
• leadership outcomes;
• behavioural outcomes;
• team performance; or
• organisational change.

Participants remain responsible for how they apply what they learn and for the decisions and actions they take as a result.

9. Online Communities and External Platforms

Some STEXEN programs, communities or learning activities may be delivered through third-party platforms such as Skool, video platforms, communication tools or other digital services.

Where this occurs, the relevant platform provider’s own:

• terms of service;
• privacy policy;
• community rules;
• account requirements; and
• acceptable-use requirements

may also apply.

STEXEN may also establish additional community guidelines or program-specific rules where appropriate.

Participants are responsible for complying with both the relevant third-party platform requirements and any applicable STEXEN participation rules.

10. Privacy

Personal information collected in connection with STEXEN participation activities is handled in accordance with the applicable STEXEN Privacy Policy.

Participants should also take care when sharing information about:

• themselves;
• colleagues;
• clients;
• employees;
• organisations; or
• other third parties.

Participants should only share personal or confidential information where they have an appropriate reason and authority to do so.

11. Relationship to Other STEXEN Terms

This Strategic Participation Notice supplements the general STEXEN Terms & Conditions.

It should be read together with:

• the STEXEN Privacy Policy;
• the STEXEN Disclaimer;
• applicable booking or purchase terms;
• program-specific rules;
• community guidelines;
• engagement agreements; and
• any other written terms that apply to the relevant activity.

Where a specific program, workshop, engagement, community or service is governed by separate written terms, an engagement agreement, booking conditions or program rules, those specific terms will apply to that activity.

Where there is an inconsistency, the more specific written terms for the relevant activity will generally prevail to the extent of that inconsistency.

12. Changes to This Notice

We may update this Strategic Participation Notice from time to time where:

• our programs change;
• our participation model changes;
• our community practices change;
• our delivery platforms change; or
• legal or regulatory requirements change.

The latest version will be published on this page and the “Last updated” date will be revised.
